|  | - Probate & Estate Administration - Probate is a legal process that takes place after someone dies. Probate is the legal process by which a person's debts are paid and assets are distributed upon his or her death. Estate Administration includes the probate process as well as non-probate transfers of the deceased's assets. Probate proceedings vary by state law and usually include proving in court that a deceased person's will is valid, identifying and inventorying the deceased person's property, having the property appraised, paying the debts and taxes, and distributing the remaining property as direct by the will, or state law (if there is no will). I help many clients, including executors, and attorneys representing clients from other states in a wide range of probate procedures, such as, heirship affidavits, small estate affidavits, a motion to determine heirship, spousal and motions to determine common law marriage. If a will is probated in another state, but includes Massachusetts property, I manage the ancillary probate proceedings in Massachusetts.
- Estate Planning and Taxation - I assist clients in maintaining privacy and control of their estate while minimizing estate taxes and avoiding probate by setting up a customized estate plan and managing a host of other estate planning matters taking into account wills, taxes, insurance, property and trust. There are a broad range of tools that can be used to achieve a clients estate planning and estate taxation goals, including: wills, trusts, revocable living trust (for single and married couples), QTIP Trust, Pour-Over Wills, powers of attorney, advance health care directives, special needs trusts, personal residence trusts, life insurance trusts, credit shelter trusts, family limited partnerships, limited liability companies, charitable remainder and charitable lead trusts.
- Real Estate - My firm handles a wide range of real estate matters, including real estate closings, working with purchasers and sellers of real estate, transfers of interest in real property and title, 1031 exchanges, deeds, warranty deeds, quitclaim deeds, title and quiet title actions, mortgage and lien foreclosures, as well as land use and zoning issues.
